E-learning / Modules – Digital Services – Terms and Conditions of Use.

This is a contract with European MRI Consultancy SARL, whose registered office is at 4, rue Gutenberg, 67000, Strasbourg, France henceforth referred to as EMRIC.

Please carefully read the following terms before accessing this site or using a course. By accessing the site (which includes, visiting, registering, purchasing or accessing a course) you accept and agree to all of the covenants and conditions imposed in this agreement. If you do not agree to these terms, you may not access the site.

By using this service, you agree that you have read, understand and agree to these terms. You also agree to review this agreement periodically to be aware of modifications to the agreement, which modifications EMRIC may make at any time. Your continued use of this site will be deemed your conclusive acceptance of any modified agreement.

Access to the e-Modules.

EMRIC will attempt to allow uninterrupted access to your eLearning material, but access to the courses may be suspended, restricted or terminated at any time. We reserve the right to change, modify, substitute or remove without notice any information in the material from time to time. You will have access to the courses you have purchased for a three-month period from the date of purchase.

Intellectual Property / Copyright.

The copyright in the material contained in the courses, together with the design, text and graphics and all software compilation belong to EMRIC. All rights are reserved. None of this material may be reproduced or redistributed without EMRIC’s written permission. You may, however, print a single copy for your own non-commercial viewing.

If you download the course material from our site, all the material and data are deemed to be licensed to you by EMRIC, for your personal, non-commercial use only. EMRIC does not transfer either the title or the intellectual property rights of the course and EMRIC retains full and complete title to the e-modules as well as all the intellectual property rights therein. You may not sell, redistribute or reproduce or convert any of the material. EMRIC owns all trademarks and logos and you may not copy or use them in any manner.

Exclusions of Liability.

EMRIC will use reasonable actions to ensure that the data in the e-module is accurate and to correct any errors or omissions as soon as practicable after being notified of them. To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained in the courses. We do not guarantee that the material will be fault free and do not accept liability for any errors or omissions.

We do not give any warranty that the website is free from viruses or anything else, which may have a harmful effect on any technology. EMRIC makes no representation whatsoever regarding the content of any other websites, which you may access from the e-modules. A link to a non-EMRIC website does not mean that EMRIC endorses or accepts any responsibility for the content or use of such websites.

Financial, Currency and Exchange Rate.

You may book in Euros. The client should pay in the currency shown on the invoice.

Online payment is the preferred method of payment with Paypal. Recognized credit cards are Visa/Mastercard/Maestro.

EMRIC quotes prices and issues invoices in Euros (EUR) only. The client must pay in the currency shown on the invoice.

Currency conversion charges from any other currency to that of the invoice is the responsibility of the client.

Fees include the licensing of training materials to a limited period of time to and appropriately qualified module content. Each license is valid to one person only and cannot be exchanged or shared.

Any sales taxes relevant to the country where the course takes place will be added to the course fees in accordance with that country’s tax regulations.

The client must pay in full or provide a purchase order before the start of the e-module, any product or course materials.

With purchase orders EMRIC will raise an invoice for the e-module fees. Any certification / exam fees are included. In the case of purchase order, the client must pay any invoice within 14 days of the date on the invoice.

EMRIC reserve the right to review the pricing and take appropriate action when changes to course or exam specification and certification occur beyond our control.

VAT: Worldwide and EU for Digital Services.

If you are a French client (company or individual), VAT is charged to 20%.

If you are a company in a EU Member State and liable for VAT, you should supply a VAT number and therefore you will not be charged for VAT. The company will be required to cancel themselves the VAT (reverse charge mechanism). This will be specifically mentioned on the invoice.

If you are a company in a EU Member State and is liable for VAT, and no intra-Community VAT number, you will be charged for VAT 20%.

If you are an individual in a EU Member State (new regulation since the 1st January 2015), you will be charged for VAT in the country of the client. And in addition you must make a statement: MOSS ( mini-one shop shop).

If you are located outside the EU Member States (company or individual): no subject to VAT in the EU.

Cancellations.

E-modules purchased cannot be cancelled and may not be transferred to other individuals.

If you cannot access the course online via www.emric.fr because you fail to meet the required system requirements given on the website, then EMRIC will not take responsibility or give a refund to the purchaser.

The start date of all memberships and access is deemed to be the date that the client first has access to the self-study materials / e-module. EMRIC will make one attempt to warn the client when this access/ membership period has ended. After this attempt EMRIC can no longer guarantee access to the e-module or that certification will be possible.

Passwords.

Clients should register for online purchasing after clicking the ‘buy now’ link. You will get a login and password to gain access to your e-modules.

Your login details are the methods used by us to identify you and so are very important. You are responsible for any payments due for services accessed through the website by anyone using your password details. Any information regarding someone using your password details should be directed to the EMRIC office immediately.

The Contract.

When you commit to the purchase of EMRIC e-learning products you agree to be bound by these Terms of Conditions. You agree to use the e-learning material for your own personal learning and not to reproduce, sell, hire or copy e-Module materials (in whole or in part) and not to use such materials except for personal reference.

Access will be given to the online materials from purchase order received for a fixed period usually 3 months unless a different period is indicated on your receipt). After this period, you may apply to have access extended provided a satisfactory reason is given. EMRIC reserve the right to refuse access after the initial period at our sole discretion.

Certification.

EMRIC will only submit a certification request on behalf of a trainee who has satisfactorily completed a certificated e-module and if the trainee has provided the required personal information.

General.

EMRIC may modify these terms and conditions at any time by publishing the modified terms and conditions on the website.
